If a girl slaps or uses force on any person in public, the victim can file a case against that girl irrespective of gender under section 321 and section 323 of the Indian Penal Code, 1860. These sections deal with voluntarily causing hurt to any person for which the accused can be punished with a maximum of one year of imprisonment, fine up to Rs. 1000, or both.
A complaint can also be filed under section 355 of the Indian Penal Code, 1860, dealing with assault or criminal force with intent to dishonour a person, for which the accused can be punished with imprisonment up to two years, fine or both.
Also, under section 159 and section 160 of the Indian Penal Code, 1860, when two or more people fight in a public place leading to disturbance in public peace, committing affray, shall be punished with imprisonment up to one month or a fine up to Rs. 100 (Rupees One Hundred Only), or both. If their fight causes any loss or damage to any property, it will result in mischief, for which maximum imprisonment of three months is given under the Indian Penal Code, 1860.
Example: In August 2021, a video was viral on social media, wherein a girl from Lucknow, out of nowhere, started slapping a cab driver repeatedly and also smashed his phone in public. After registering an FIR, she can also be convicted under section 323, section 425, section 427 and section 160 of the Indian Penal Code, 1860.
